CREDIT TERMS AND AGREEMENTS

This document serves as an Application and Agreement for credit and pertains to all credit extended by NMS Transport Ltd. By submitting this application, the credit applicant acknowledges and accepts the following terms and conditions of sale: 1. The terms of sale are net 30 days. In case of overdue accounts, interest will accrue at a rate of 2% per month (24% per annum), starting from the first day the account becomes overdue. *No agents or representatives of NMS Transport Ltd are authorized to alter or adjust credit terms without written authorization from the Credit Manager. 2. Any claims against invoices must be raised within 30 days of receiving the service. Disputes must be reported in writing to the Credit Manager of NMS Transport Ltd within 30 days of service, along with the details of the dispute. Failure to do so within the specified timeframe obliges the applicant to settle all outstanding amounts owed to NMS Transport Ltd, irrespective of unresolved disputes. 3. Replacement copies of lost or misplaced invoices may incur a $20.00 charge. 4. NSF cheques will be subject to a $25.00 charge. 5. Non-compliance with these Terms and Conditions may lead to the cancellation of credit privileges without prior notice. In the event of default, NMS Transport Ltd reserves the right to close the account and/or demand immediate payment of the full balance. 6. The applicant is responsible for all costs associated with collecting any unpaid amounts, including collection suit fees, legal fees, and court costs. 7. The information provided in this Application and Agreement must be accurate and true and is furnished solely for the purpose of obtaining credit. 8. The applicant consents to the retrieval of credit and/or personal information as necessary for processing the applied credit line or any renewals/extensions thereof and agrees to the disclosure of trade information to credit reporting agencies or other relevant entities. 9. NMS Transport Ltd reserves the right to close or reduce the credit limit of the account if the customer’s creditworthiness deteriorates or fails to meet current credit standards. 10. In cases of multiple parties involved, all parties are jointly and severally liable in the event of default under this agreement. 11. The Owner is obligated to inform NMS Transport Ltd in writing of any changes in ownership. 12. The applicant grants NMS Transport Ltd a security interest in all personal property stored or left in the possession of NMS Transport Ltd until all outstanding amounts owed by the applicant are paid.
